TERMS AND CONDITIONS
WELCOME TO THE ONLINE SHOP OF VINTAGE WATCH STORY
These Terms and Conditions ( hereinafter " Terms ") are concluded between the company VWS , SAS with a capital of 20 000 euros registered @ the RCS of Bordeaux under number 795 383 827 , whose registered office is at 2 Cours du 30 Juillet - 33064 Bordeaux cedex France (hereinafter " VWS ") , and any person making a purchase via the online store of VWS ( hereinafter "Customer") , available at URL vws.fr (hereinafter the "Site ").
1 . Subject to Conditions
The Terms are intended to define the rights and obligations of the parties in the online sale of goods offered by VWS to the Customer (the "Products ").
The Customer is informed that VWS can be:
- Either directly as a reseller of products,
- Either as custodian of products, holds a sale mandate entrusted by the applicant seller (the " Depositor ").
2 . Acceptance of Terms
These Terms shall prevail over all other conditions contained in any contradictory document , the act of purchase involving acceptance of these terms of sale .
By confirming the order, the Customer acknowledges and expressly accept all of these Terms without reservation.
This confirmation and all data recorded VWS will constitute proof of actual transactions between VWS and the Customer.
These Terms are subject to change at any time and without notice.
3 . The offer
Every item offered on the Site is :
- A detailed product ( model identification , movement, size, condition, accurate description ... ) description ,
- A firm fixed-price stated in euros, including VAT, but excluding the participation fee for processing , preparation and shipment of the order , and
- Several photographs, only illustrative, not included in the contract.
If errors occur, in no case VWS responsibility can be initiated .
Any order implies acceptance of price and product description .
Also, the Customer is strongly urged, before ordering, to contact VWS directly by email or phone, using the contact details on the "Contact Us" page , for any question on any products, in order to get more information . If necessary , it may be agreed to a meeting between VWS and the Customer that he can assess the product directly.
The offer proposed in the site is valid worldwide .
4 . stock
The offers are valid until the products offered are visible on the site , within the limits of available stocks.
In the event of unavailability of a product after placing the order, VWS inform the Customer by e -mail . The order is automatically canceled and the customer paid by bank transfer.
The products remain the property of VWS or of the Depositor until full payment of the price by the Client.
5. Placing the order
In accordance with Article 1369-5 of the Civil Code, ordering online is evidenced by performing the following steps:
- Choice of the product (s) and add to cart ,
- Validation of the basket, and
- Confirmation of the order by the Customer.
The order can be changed at any time until the final confirmation by the Client, which is final acceptance of the offer and triggers the processing of the order.
VWS confirms the acceptance of the order by the Customer by an e -mail to the address provided by the Customer.
VWS reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order .
The information provided by the customer during the order taking, are his own : in case of error in the address of the recipient, VWS can not be held responsible for failure in which it could deliver the product.
6 . payment
The price charged to the customer is the price indicated on the order confirmation sent by VWS or in the pro-forma.
The payment of the order is payable immediately on the date of validation of the order .
Payment is made in euros by Carte Bleue , Visa , MasterCard, Paypal, check or postal order payable to VWS , or bank transfer.
The order validated by the Customer will not be considered effective until actual receipt of amounts due to VWS . In case of refusal of acceptance by the bank, VWS reserves the right to cancel the order being made by the Customer .
7 . Shipping and Delivery
Shipping is done within maximum a week after receipt of payment of the ordered product. Deliveries are made Declared Value or by any other secure means chose by VWS .
Products and accessories are delivered to the delivery address specified by the customer during the order process, in the entire world. Entry errors remain the sole responsibility of the Customer and must assume the delay in shipping, the cost of a possible return and the possible loss of the parcel .
Delivery costs are charged to the Customer at the end of the order in addition to the price of selected products.
For a request delivery in a country other than France, the Customer must contact before ordering VWS to request a quote.
VWS can not be held responsible for any delays or impossibility to perform its contractual obligations related to events of force majeure by existing case law .
8 . Custom Duties
Any order placed on the site and delivered outside France may be subject to customs duties and to taxes which are levied when the package reaches its destination. The latter related to the delivery of an item are the responsibility of the Customer and under its responsibility .
VWS is not required to check and notify the Customer of duties and taxes. To know it is the Customer to check with the competent authorities of his country.
9 . Selling Online - withdrawal
Pursuant to Article L. 121-20 of the Consumer Code , the Customer has a period of seven days to withdraw without having to give reasons or pay penalties , except for the cost of returning the product to the date receiving the command.
Products must be returned in their original condition , in their original packaging, if accompanied by appropriate accessories and manuals and documentation, in perfect condition for resale to the following address :

Any product that has been damaged or whose original packaging has been damaged , will not be refunded or exchanged.
Pursuant to Article L. 121-20-1 of the Consumer Code , VWS reimburse the Customer as soon as possible and no later than thirty days from the date of withdrawal.
Refunds will be made via the payment method used by the Customer or the Customer's choice , in the form of a credit note, within 30 days.
10 . Defective products - legal guarantees
All products offered on the Site are subject to the legal guarantee of conformity (Articles L. 211-1 and following of the Consumer Code ) and the warranty against hidden defects (Article 1641 of the Civil Code ) , allowing the Client to return defective products .
The legal guarantee can be invoked if the non-compliance is established within two years from the date of receipt of product. If the determination is made more than six months after the date of delivery, the customer is required to prove the existence of the non- conformity of the Product at the time of delivery.
11 . Contractual warranty
The Products purchased on the Site are entitled to a contractual guarantee for one year from the date of purchase. This is valid for each product on the Website . To know the steps to follow on for the after-sales service, for any problem or failure of a product, the Customer must contact VWS at contact@vws.fr .
To benefit from the contractual guarantee of products, it is imperative to keep the purchase invoice of the product.
The contractual guarantees do not cover:
- The replacement of consumables ( batteries. .. )
- Abnormal or improper use of the products,
- Defects and their consequences related to any external causes (accidents , shock, immersion, wear ... )
- Damage by the intervention of an unauthorized repairer by VWS .
However, in any event, the Customer has the legal provisions of the guarantee specified in Article 10 above.
12 . Law - Settlement of Disputes
These Terms are governed by French law.
The language of this contract is the French language.
In case of difficulties in the implementation of this contract, the parties agree on the possibility, before any legal action, to seek an amicable solution to the settlement of any dispute that may arise during the execution of the contract.
Any claim relating to a command is to submit :

If unable to agree on an amicable solution , the French courts will have jurisdiction .
